Toward the end of October, a Long Island truck accident occurred when a 2008 Freightliner panel truck hit a 71-year-old woman while she was crossing the street. The accident took place in Rockville Centre at the intersection of Lincoln Ave. and South Park. The driver was making a left turn from an eastbound lane to go north on South Park. The accident scene was near the location of a senior center.

As a result of the collision, the woman suffered serious head injuries and was taken to a nearby hospital where she was pronounced dead.

The truck driver remained at the accident scene. Officials tested the vehicle’s brakes and other safety factors, and the investigation was still underway. (Source: Patch News, Garden City, Long Island in NY )

Legal Implications Involved in a Long Island Truck Accident

When investigating a Long Island truck accident, authorities and truck accident lawyers look into matters such as proper vehicle maintenance, the condition of the driver (alcohol or drug usage, sleep deprivation, etc.) and whether the driver and pedestrian adhered to traffic laws.

New York’s Right of Way Law

Under New York State traffic laws, when there is no traffic signal, drivers must yield the right-of-way to pedestrians, especially if the pedestrian is crossing in a crosswalk or if there is risk of danger to the pedestrian.

Approximately 300 pedestrians die every year in New York State. Pedestrians often face high risks and certain locations have higher incidence of fatalities than others.
